Kremlin's rights council blasts Pussy Riot verdict

MOSCOW (AP) ? The Russian presidential human rights council is questioning the guilty verdict and two-year prison sentences against three members of punk provocateurs Pussy Riot.

The council said in a statement late Tuesday that "criminal law was used to deal with actions which entail administrative liability only" in the case. Members also questioned why the court did not impose suspended sentences on two of the three women who have small children.

Council members expressed dismay over a decision to keep Nadezhda Tolokonnikova, Maria Alekhina and Yekaterina Samutsevich hand-cuffed in a bullet-proof glass cage during the hearing of the verdict.

"We are confident that the civil society has the right to demand that Russian justice be governed by the truth and mercy," the council said.

The council is an independent advisory body appointed by the president and its recommendations are not binding. All of its members were appointed under former President Dmitry Medvedev.

The group is up for a reshuffle since some of its most critical members have resigned, saying that they don't want to work under President Vladimir Putin. The new council could be less critical, but has had very little sway over government decisions.

The three women were found guilty of hooliganism motivated by religious hatred earlier this month after performing a "punk prayer" against Putin in Moscow's main cathedral. The verdict caused protests and outrage both in Russia and abroad.

The women on Monday filed an appeal of the verdict which is expected to be heard within the following 10 days. Meanwhile, the band said at least two of its members have fled Russia to avoid arrest.

Star Wars Episodes II and III 3D re-releases officially dated for theaters in September and October 2013

Star Wars Episodes II and III 3D rereleases coming to theaters in September and October 2013

Before Star Wars Episode I: The Phantom Menace came back to the theaters earlier this year converted for 3D, the plan was to bring the other five movies to theaters one at a time each year, but that has apparently changed. At the Star Wars Celebration VI event in Orlando (where we first found out about the Blu-ray release two years ago) Lucasfilm announced that Episodes II and III in 3D will be released in theaters back to back in fall of 2013, arriving September 20th and October 11th, respectively. Missing so far from the announcement? A reason for the back-to-back release or any word on Blu-ray 3D plans. In lieu of more details, although it means Attack of the Clones will come back later in the year than Phantom Menace did, with any luck this accelerated schedule is a good omen for the original trilogy's return. Of course, we'll have to wait and see what magic can be worked with those older film and special effects elements, however IGN apparently found an early preview of the Episode II 3D footage to be promising.

(AP) ? President Barack Obama said Mitt Romney has locked himself into "extreme positions" on economic and social issues and would surely impose them if elected, trying to discredit his Republican rival at the biggest political moment of his life.

In an interview with The Associated Press, Obama said Romney lacks serious ideas, refuses to "own up" to the responsibilities of what it takes to be president, and deals in factually dishonest arguments that could soon haunt him in face-to-face debates.

Obama also offered a glimpse of how he would govern in a second term of divided government, insisting rosily that the forces of the election would help break Washington's stalemate. He said he would be willing to make a range of compromises with Republicans, confident there are some who would rather make deals than remain part of "one of the least productive Congresses in American history."

With the remarks, Obama set up a contrast between Romney, whom he cast as an extremist pushing staunchly conservative policies, and himself, by saying he would work across party lines. It was a seeming play for the independent voters who decide close elections and tell pollsters they want to see the often-gridlocked politicians in Washington solve the nation's problems.

Mainly, Obama was intent on countering Romney even before his challenger got to the Republican National Convention, which starts Monday in Tampa, Fla. In doing so, the president depicted his opponent as having accumulated ideas far outside the mainstream with no room to turn back.

"I can't speak to Gov. Romney's motivations," Obama said. "What I can say is that he has signed up for positions, extreme positions, that are very consistent with positions that a number of House Republicans have taken. And whether he actually believes in those or not, I have no doubt that he would carry forward some of the things that he's talked about."

Obama spoke to the AP on Thursday before heading off to a long weekend with his family at Camp David, the secluded presidential retreat in the Maryland mountains.

The president was at ease but doggedly on script, steering even personal-themed questions about Romney and running mate Paul Ryan into answers about starkly different visions for helping the middle class.

Romney, a successful former executive of a private equity firm and one-time Massachusetts governor, will introduce himself to a TV audience of millions next Thursday as he takes the convention stage to accept his party's presidential nomination. He has offered himself as a business-minded alternative to Obama and has seized on voter concerns about joblessness and the direction of the nation.

Nearly 10 weeks before Election Day, the race is remarkably stable and reflective of a sharply divided nation, with registered voters about evenly split on their choice and nearly a quarter of them unsure or still willing to change their mind. Across the interview, Obama's messages often seemed directed at moderate and independent voters whose sway could make the difference.

Obama's depiction of a Romney presidency grew most pointed when he was asked if his Republican challenger has no core, as one of Obama's top advisers once put it.

The president suggested that whatever Romney really stands for in life is secondary to the promises Romney has made in the campaign.

In explaining his accusation of "extreme" positions, the president cited Romney's call for across-the-board tax cuts that Obama said would mostly help the rich at the expense of everyone else and cost the nation $5 trillion. Obama singled out Romney's opposition to tax credits for producers of wind energy, the kind of issue that carries large political resonance in a battleground state such as Iowa.

And Obama alluded to the provocative issue of abortion, suddenly thrust to the fore this week when Republican Missouri Senate candidate Todd Akin said the female body has a way to "shut that whole thing down" when a woman is the victim of "legitimate rape."

The Republican platform in Tampa calls for a ban on abortion with no specific exceptions for rape or other circumstances. Obama predicted that a President Romney would not "stand in the way" if Congress gave him a bill that stripped away women's control over their reproductive health.

Romney is on record, however, as not opposing abortion in cases of rape and incest or if it will save the mother's life.

Polling shows social issues such as abortion represent perhaps Obama's best opportunity to draw support from Romney. Obama already holds a broad lead as the candidate more trusted to handle those social issues among Democrats and independents. The issue is one of Romney's biggest vulnerabilities among moderate and liberal Republicans.

Obama also sought to chip away at Romney's trustworthiness, taking fresh shots at Romney's refusal to release years of tax returns for public inspection. He said that position was indicative of a candidate who has a "lack of willingness to take responsibility for what this job entails."

Yet it is the economy that has driven this election and has dominated Obama's message of a middle-class revival.

"We aren't where we need to be. Everybody agrees with that," said Obama, who inherited an economy in free fall and now bears responsibility for a recovery that remains weak. "But Gov. Romney's policies would make things worse for middle-class families and offer no prospect for long-term opportunity for those striving to get into the middle class," the president said.

A Romney spokesman, Ryan Williams, jumped on Obama's account in the interview that the economy clearly needs to get better. "Mitt Romney and Paul Ryan agree," Williams said. "The American people know they aren't better off than they were four years ago."

Obama holds a decisive advantage over Romney when Americans are asked who better understands their daily woes. Yet nearly two-thirds of people in a new AP-GfK poll say the economy is in poor shape, and 60 percent say the country is headed in the wrong direction.

Obama expressed confidence that even voters whose lives have not improved during his term will stick with him as they assess the two candidates.

"If they saw Gov. Romney offering serious proposals that offered some sort of concrete ways in which middle-class families would be helped, then I could understand them thinking about that choice," Obama said. "But that's not what's happening."

And therein lies the central case that Obama made in the interview, as he has made for months, and as he will again at his own party's convention in Charlotte, N.C., in early September.

Obama said he is the candidate whose policies have historically helped the middle class on issues that people care about and that shape the economy ? education, manufacturing, science and research, Medicare, debt reduction, tax rates, health care, consumer protection, college aid, energy.

Williams, the Romney spokesman, responded that Obama has piled up national debt and presided over high unemployment. "Too many middle-class families are going to sleep each night worried," he said. "This may be the best President Obama can do, but it's not the best America can do."

The moment that could finally shake up a close race could come in the three debates Obama and Romney hold in October. The president said Romney could run into trouble because of arguments that are not backed up by facts, citing a widely debunked television ad campaign in which Romney accuses Obama of gutting the work requirement in the federal welfare law.

"It will be a little tougher to defend face-to-face," Obama said.

Obama's view of a different second-term dynamic in Washington, even if both he and House Republicans retain power, seems a stretch given the stalemated politics of a divided government. He said two changes ? the facts that "the American people will have voted," and that Republicans will no longer need to be focused on beating him ? could lead to better conditions for deal-making.

If Republicans are willing, Obama said, "I'm prepared to make a whole range of compromises" that could even rankle his own party. But he did not get specific.

The 25-minute interview, conducted in the library of the White House residence, was part of a multi-faceted campaign by Obama's team to snag some of the spotlight during Romney's big week. Obama denied the notion, widely if quietly held in political circles, that the fiercely competitive president is also driven to beat Romney because he does not hold him in high regard.

"I don't really know him well," Obama said. "The big arguments that I have with Gov. Romney have to do with where we take this country forward."

Red Sox the winners in mega deal

I?m still shaking my head at the Dodgers-Red Sox deal, which is now finalized. Among the things that wouldn?t have made sense to me if you told me about them this time yesterday:

  • I?m surprised that the Dodgers ? whose owners just paid $2 billion for that team ? took on $271 million in financial obligations and actually gave up real talent to boot.
  • Though I understand the Red Sox wanting to get rid of Beckett and Crawford, I?m surprised they actually did it. There has seemed to be so little consistency and coherence in that front office over the past two years I?m frankly shocked that a consensus to start over, more or less, was reached.
  • Heck, I?m surprised that someone decided that the deal had to include Nick Punto. Like, on that call, at some point, either Ned Colletti insisted that Nick Punto was a must-have or Ben Cherington decided that Punto and his $450K or so that he?s owed for the rest of the season had to be unloaded too.

But expectations flummoxed or not, it did happen, and it?s hard to see how this isn?t a win for the Red Sox. Albeit maybe not as big a win as some folks are making it out to be.

The winning part: A cleansing purge of Josh Beckett, who no one liked anymore and who seems to be a shadow of his former self. A liberating purge of Carl Crawford?s contract which, while it seemed like an overpay when it was signed before the 2011 season, has quickly turned into an all-out albatross given two years of injury and the realization that, no, he?s not gonna age as well as some thought.

And, of course, the?acquisition?of some young, promising players in Rubby De La Rosa, who ? even if we should never put too much hope in any one pitching prospect ? could be an ace one day, and Jerry Sands who may find Fenway to his liking and should have a greater chance to play on these new-look Sox. Throwing in Ivan DeJesus as depth and Allen Webster who, while maybe a year or two away, could definitely feature in the Sox rotation one day, and you have a lot of pieces for the next good Red Sox team. I don?t think James Loney is worth mentioning, but I?m sure he?s a nice fellow.

But let?s temper our expectations. Upside or not, none of the pieces coming back is a sure thing. De La Rosa could struggle with command as so many post-Tommy John pitchers do. Sands has been a creation of the Pacific Coast League so far, so he?ll have to prove himself. ?But the biggest place to temper expectations should come in the financial relief the Red Sox received. Because while, sure, it?s awesome to have $50 million+ free a year going forward, it?s not like there?s a never-ending supply of talent to spend it on.

Teams are locking up young talent so early these days, leaving far fewer blue chippers to actually hit the market. ?Matthew will take a look at this in greater depth later, but let?s quickly look at who?s available this offseason: Josh Hamilton. Zack Greinke. Robinson Cano. Jhonny Peralta. David Wright. Michael Bourn. Only two of them ? Cano and Wright ? are unequivocal game-changers, and those two are highly unlikely to actually be available when it?s all said and done. UPDATE: Er, scratch that. I forgot that Cano and Wright have team options, so that makes it worse. The other free agents have question marks or aren?t slam dunks. They?re all basically Carl Crawford, right? And the Sox are clearly repudiating the idea of signing the Carl Crawfords of the world right now.

So, you take that $50 million and plow it into player development, right? Well, some of it. The new collective bargaining agreement prohibits teams from doing that with any sort of gusto. Between the draft and international signings you can only spend a fraction of that money. So no, you can?t use that to really go crazy on either the free agency market or player development. At least not all at once.

Put differently: the Red Sox are retrenching for the long-haul, and the days of them being somehow exempt from the success cycle that every other team but the Yankees is subject to are over. ?There?s a lot of talent on this team and a lot more flexibility now, but if you overhear any Red Sox fan saying, thank god, now the team can go out and sign some real free agents, you should feel free to ignore them. ?Because there?s a better chance that the biggest short term upside of this deal for Boston are increased profit margins due to decreased labor costs as opposed to some quicky-re-load of a rebuild. ?That doesn?t make it a bad deal for them ? I think Boston won this trade ? but it?s not like there isn?t risk about it all and it?s not like there aren?t some rough days still ahead.

Turning to the Dodgers: man, where is all of this money coming from? ?I know the new ownership is flush with cash and/or credit ? how can you pay $2 billion for the team if you?re not? ? but they also just jacked their payroll up to the $190 million range for 2013. I know they have a new TV deal in the offing and I know the fans are coming back to Dodger Stadium now that Frank McCourt is gone, but this is not quite the money-printing market that, say, New York is. And even the Yankees have pushed their payroll down in recent years.

But the finances of it all are between Mark Walter, Magic Johnson, their silent partners and their gods. What?s it mean for the baseball side? ?An improvement, sure, but not a dramatic one, necessarily. And, like Boston, there?s risk here, albeit risk of a different kind.

Carl Crawford won?t play this year. Josh Beckett and Adrian Gonzalez have each had down years, though Gonzalez has had a much better second half. Even assuming, however, that Gonzalez and Beckett suddenly take on vintage form, there are only 36 games left to play and they?re in a three-game hole in the west and a 1.5 game hole in the wild card. Sure, it?s possible that their addition pushes the Dodgers past San Francisco and/or the other wild card contenders, but it would take a hell of a month or so from them to do it.

The long-term is murkier. I feel like Adrian Gonzalez has several good years left in him and he may find himself rejuvenated to be back in the NL (and in his homeland of Southern California). Beckett and Crawford, however, are much shakier bets.

It?s hard to remember that Beckett is only a year removed from a season in which he put up a 2.89 ERA and a WHIP of 1.026, but that?s one year surrounded by two in which he looks like any old palooka, not the ace he once was. Nothing about him at this point suggests a pitcher who is going to age particularly well ? Josh, it?s called a treadmill, please hit it ? but it could happen. Crawford had Tommy John surgery just this week. I really have no idea what he?s going to be like going forward. Speed ages well and, assuming his arm isn?t toast after all of this, his defense will be a bigger plus in L.A. than it was in Boston. He could have a couple of All-Star years left in him or he could turn into Roberto Kelly.

The money here is the ultimate arbiter. If the Dodgers are like every other team in the history of baseball, they will not be able to absorb three gigantic contracts which correspond with only one elite player. There just is no way to eat that much cash and still field a consistently competitive team. ?If, however, Beckett and Crawford find the fountain of youth, or if the Dodgers? brass really has tapped into some crazy new revenue that we?re really not appreciating right now, it could all work out.

Going back and reading all of that it sounds like a bunch of negativity. I really don?t mean it to be. This deal is as exciting as all hell. It?s one of the biggest trades in baseball history, really, in terms of both big names and cash. ?And with a trade so big it?s understandable that there are downsides for each side. No one ever completes a monster deal without some sort of risk or misgiving because, at the highest levels of business sophistication, no one truly gets suckered.

But on balance, if I had to say who won this one, I?d say it?s the Red Sox. Mostly because they now have far, far less to lose.

How to Build a Facebook Presence that Delivers for Your Business ...

How can your small business get the most out of Facebook? During the judging phase of OPEN?s Big Break for Small Business? contest, I asked my fellow judges to talk about how business owners can use Facebook to promote their companies. Facebook?s Heather Freeland, Bonobos CEO Andy Dunn and ?SmallBizLady,? small business expert and best-selling author Melinda Emerson all had insights to share.

How can business owners new to Facebook get the most from it?

Emerson: Start by creating a business page and posting status updates to it regularly. Share links to articles and your own blog entries, if you have a blog. Post thought-provoking questions along with the links to encourage fans to participate. Facebook is a great place to share visuals, so post photos and videos as much as possible.

Dunn: Remember to treat Facebook as a two-way conversation. If you?re self-serving, you?ll miss what social media is all about. At Bonobos, (a men?s clothing retailer), about 80 percent of what we say on our Facebook page isn?t self-promotional. We do quizzes, and we ask questions like ?What?s your response when someone says, ?Nice pants??? It?s the interaction that counts.

Freeland: I recommend using the Page Insights tool to better understand who your fans are and what type of content engages them most. It lets you see how many fans you reach with each post and how they respond?for example, by ?liking? your posts, commenting on them or sharing them. You can also use the information provided by this tool to target prospects who resemble your current fans, which can help expand your pool of contacts.

What are some effective examples of social media marketing on Facebook?

Freeland: Last year?s Big Break contest winners provided some terrific examples. Spoonflower, a custom fabric printing company holds weekly fabric-design competitions on its Facebook page. Designers ask their friends to vote for them, which builds awareness for the company. Another winner, Big Daddy?s Barbeque, brought its physical community online by printing ?Like us on Facebook? on receipts and handing out promotional cards with the same message outside churches and salons in their community. Relatively simple actions like these can be very effective.

Dunn: Integrate your website?s login with the Facebook Open Graph so your site experience ties seamlessly to the social graph. In addition, featuring limited-time offers on Facebook can amplify awareness via the social graph?allowing customers to share the deals within their networks.

Emerson: I like to use my SmallBizLady page on Facebook to highlight special fans. Each month, I choose a fan to write a guest post on my blog and then promote the post on Facebook. If I have a photo of the fan, I?ll post it as well. It?s an excellent way to give a shout-out, and the fan is thrilled. This is one of the methods I use to generate traffic to my blog from Facebook.

Bonobos has seen great success with Facebook advertising. Could you describe your approach?

Dunn: Facebook ads have been a fantastic source of customers for us. When you launch a brand, you?re trying to create demand for a brand that doesn?t exist in customers? minds yet. Facebook?s highly personalized display ads give you a powerful way to do this.

Our core customers are 18- to 40-year-old men who are active and like to play sports. Many of them live in New York, California, Illinois, Boston, Philadelphia and Washington, D.C. Facebook allows us to distribute ads directly to this group. We can also run several different campaigns and analyze the responses. Based on the results, we decide which campaigns we?ll invest in further and which ones we?ll retire.

What advice would you give to a business owner who has tried marketing on Facebook but hasn?t yet seen strong results?

Emerson: Try again and really focus your efforts. You need to know who your target audience is and provide them with helpful content on a daily basis. Inconsistent and undisciplined social media marketing efforts won?t pay off.

Freeland: Building an effective Facebook presence takes time. Look into resources that can help you make the most of your business page, such as the Facebook Marketing Classroom and the Facebook Marketing page. These resources provide wonderful tools, tips and webinars to help you optimize results. Women with Alzheimer?s deteriorate faster than men

ScienceDaily (Aug. 23, 2012) ? Women with Alzheimer's show worse mental deterioration than men with the disease, even when at the same stage of the condition, according to researchers from the University of Hertfordshire.

In the paper published in the Journal of Clinical and Experimental Neuropsychology, the researchers discovered that men with Alzheimer's consistently and significantly performed better than women with the disease across the five cognitive areas they examined. Most remarkably, the verbal skills of women with Alzheimer's are worse when compared to men with the disease, which is a striking difference to the profile for the healthy population where females have a distinct advantage.

The researchers led by Professor Keith Laws completed a meta-analysis of neurocognitive data from fifteen published studies, which revealed a consistent male advantage on verbal and visuospatial tasks, and tests of both episodic1 and semantic2 memory.

Keith Laws, Professor of psychology, said: "Unlike mental decline associated with normal aging, something about Alzheimer's specifically disadvantages women.

"There has been some previous, but limited, evidence that females with Alzheimer's deteriorate faster than males in the earlier stages of the disease. And possible explanations are for a hormonal influence, possibly due to oestrogen loss in women or perhaps a greater cognitive reserve in males which provides protection against the disease process. But further studies to examine sex differences with the disease are needed to provide greater clarity on these issues."

Further analysis of the study data showed that age, education level and dementia severity did not explain the advantage that men with the disease have over women with the disease.

Alzheimer's disease, a common progressive condition affecting memory, thinking, behaviour and emotion, is the most common form of dementia. Alzheimer's Disease International estimates that there are currently thirty million people in the world with dementia, with 4.6 million new cases every year. The incidence of Alzheimer's is greater among women than men, with the difference increasing with age.

Microsoft has swapped its old monochromatic stylised logo for a brand new one that brings a simplified version of the previous Windows ?Window? logo and a softer, sans-serif, grey font.

It marks the beginning of an epic 100 days that lie ahead of the company that was once the biggest technology enterprise in the world.

By the end of the year, the company will have launched its boldest Windows operating system yet (Windows 8), started its transformation into an Apple-inspired company (Surface tablet PC), continuing its divorce with Intel by embracing ARM (Windows RT), kickstarted the cloud computing revolution within the company (Office 2013), and attempted to become relevant on the web (Outlook.com, IE10) as well as on mobile (Windows Phone 8).

That?s a lot of dramatic changes for any company, even more so for a company like Microsoft which, as a corporation of titanic proportions, is not usually used to changes on that scale. And the fact that Windows is now an integral part of Microsoft?s logo can only send a powerful message to partners and rivals alike.

Microsoft will put Windows at its heart, more than ever before, and ironically, it hints at the possibility that the OS might finally become a cross-platform, all singing, all dancing and all-encompassing ecosystem that once attracted the ire of the US Department of Justice more than a decade ago.

I like shoot 'em ups quite a bit, but rare are the days when I play one for more than 10 minutes before cursing at it and quitting (I'm looking at you, Ikaruga). They have a tendency to be profoundly demanding and difficult -- ?ironically the two ingredients that keep most diehard fans coming back. You'd think A Space Shooter Blitz, a shoot 'em up coming to Facebook (and iOS and Android) on September 20, would dial things down a bit for the so-called casual audience, but that's not the case. In fact, developer Frima Studios is tagging it as a "bullet hell" title. I should probably brace myself for the yelling of curse words.

Police: Woman says man called from Ark. squad car

LITTLE ROCK, Ark. (AP) ? The girlfriend of a man who was fatally shot in the back of an Arkansas patrol car told an investigator that he called her from the car and said he had a gun with him, police said Wednesday.

Jonesboro police offered those and other new details in a four-page statement about the investigation into the July 28 death of 21-year-old Chavis Carter. The death was ruled a suicide in an autopsy report released earlier this week.

Carter's girlfriend also told the investigator that Carter said he loved her and that he was scared, according to the police statement, which did not identify the woman. Phone records showed Carter made two calls, at least one of which was from the back of the patrol car, police said.

Benjamin Irwin, a Memphis, Tenn., lawyer representing Carter's family, said Wednesday that he was reviewing the latest information from police.

"I think the critical points still remain that this young man was in police custody," he said. "He lost his life at a time when they had a responsibility and duty to protect him."

Police have been facing criticism since they said officers searched Carter twice but didn't find a gun before he was fatally shot in a patrol car. Race is also an issue in the case because Carter was black and police have said the two officers who stopped the truck he was in are white.

The police statement said there appears to be no doubt that an officer missed the gun when he initially patted Carter down.

"It is presumed that Carter secreted the gun in the rear of the car after the pat-down but before the cuffing and second search," the statement said.

The statement said it was meant to be "a brief preliminary investigative summary" and noted that the investigation into Carter's death isn't complete. However, the statement said evidence and witness statements support the medical examiner's conclusion that Carter killed himself.

Spokesman Sgt. Lyle Waterworth didn't respond to an email or phone message seeking further comment.

Police also said they tracked down a man from a video on Carter's phone who said he sent Carter a text message asking him to bring him a gun shortly before his run-in with the officers. That man also said Carter was involved with a drug deal involving 4 ounces of marijuana, police said.

Police have said officers found marijuana on Carter when they searched him. The autopsy report also said he tested positive for meth and other drugs.

The police statement also said blood spatter on Carter's right hand showed his hand was close to the contact wound on his right temple. Blood was also on a rear passenger door of the patrol car, police said.

Officers and bystanders said the patrol car doors and windows were closed and that the officers weren't near the car until Carter was found, police said.

"This virtually eliminates any possibility that the fatal wound was caused by any weapon other than the one recovered in the rear of the vehicle and that its discharge was caused by Carter," police said in the statement.

The Arkansas state crime lab confirmed Wednesday that it did not perform gunshot residue testing on Carter, saying it doesn't do that kind of analysis on victims of homicides or suicides.

The confirmation came after Jonesboro Police Chief Michael Yates told The Associated Press that the department had requested the testing but that it wasn't done because of the agency's policy.

The lab's chief criminalist, Lisa Channell, said the testing can indicate whether a person was in an environment with gunshot residue, but "it cannot tell you whether the person pulled the trigger or not."

The crime lab's policy is not new. A 2001 memo sent to law enforcement officers said being in close proximity to a gun when it's fired can lead to positive gunshot residue test results and that negative gunshot residue results don't mean someone didn't fire a gun.

Still, Irwin questioned why the test wasn't conducted.

"To me, that's horrible," he said.

Police previously released video recorded from dashboard cameras the night of the shooting, but the footage didn't appear to show when officers found Carter slumped over and bleeding in the backseat of a patrol car as described in a police report.

Police said there were problems with the audio and video that explain the absence of a gunshot or noise on the recordings.

Irwin, Carter's family's lawyer, didn't buy that explanation.

"These things are crystal clear from a reception standpoint and from a functioning standpoint," he said. "And then they just malfunction for three minutes when this young man lost his life? I am just not ready to accept that as the answer."

The police statement came out less than an hour before Carter's mom marched with the Rev. Jesse Jackson and other supporters in Jonesboro.

"We hope that people concerned about justice, white and black, would find some common ground as we pursue this case of justice," Jackson told reporters in Memphis, Tenn., hours before the Jonesboro march. "We simply want justice and fairness in the land. ... We are convinced the explanations given so far are not credible ones."

Syria hints Assad could go in peace deal

A top Syrian minister on Tuesday held out the prospect of strongman Bashar al-Assad stepping down as part of a negotiated settlement to 17 months of bloodshed that activists say has killed 23,000.

"As far as his resignation goes -- making the resignation itself a condition for holding dialogue means that you will never be able to reach this dialogue. But any problems can be discussed during negotiations. We are even ready to discuss this issue," Deputy Prime Minister Qadri Jamil said in comments translated into Russian.

His remarks came as heavy shelling and fighting erupted across swathes of Syria's second city of Aleppo, as both the regime and rebels claimed they were gaining ground in the key northern battleground.

At least 24 people were reported killed nationwide, among them women and children in Aleppo, as the regime pressed its onslaught on rebel areas a day after US President Barack Obama warned Damascus over its chemical weapons arsenal.

Russian Foreign Minister Sergei Lavrov reacted by bluntly telling the West not to meddle in Syria, but also criticised the regime for failing to do enough to end a conflict that has exposed deep rifts among world powers.

On the ground, and heavy shelling was reported in Aleppo, including an area where a Japanese journalist was killed after being caught up in gunfire on Monday, while war planes bombarded the northern town of Marea, activists said.

The rebel Free Syrian Army said Tuesday it controlled almost two thirds of Aleppo, which has been battered by a month of air strikes, shelling and fighting, but a security source in Damascus rejected the claims.

Activists also reported that troops had stormed a town near Damascus, torching homes and shops, while helicopters and war planes strafed several suburbs of the capital, which the regime claimed to have largely recaptured last month.

The death of Japanese female reporter Mika Yamamoto, 45, brought to four the number of foreign journalists killed in Syria since the uprising erupted against the regime of President Bashar al-Assad in March 2011.

The Syrian Observatory for Human Rights said three other journalists -- a Lebanese woman, an Arab male and a Turkish national -- were missing.

Obama had put Assad's regime on notice Monday that although he had not ordered military intervention "at this point," the United States was "monitoring the situation very carefully," and had drawn up contingency plans.

"There would be enormous consequences if we start seeing movement on the chemical weapons front or the use of chemical weapons... That would change my calculations significantly," he told reporters.

Obama said the United States would regard any recourse by Damascus to its deadly arsenal as crossing a "red line".

Syria's admission in July that it has chemical weapons and could use them in case of any "external aggression" added a dangerous dimension to a conflict that has now killed at least 23,000 people, according to the Observatory.

But Lavrov, whose government is one of the regime's few remaining allies, said Tuesday: "There should be no interference from the outside".

"The only thing that foreign players should do is create conditions for the start of dialogue."

The UN Security Council has so far failed to agree on action to contain the bloodshed or deal with the increasingly embattled Assad after Russia and China both vetoed resolutions on the conflict.

But Lavrov also told a visiting Syrian envoy that efforts by Damascus to end the conflict were "not enough".

Lakhdar Brahimi, who has replaced former UN chief Kofi Annan as international Syria envoy, warned Sunday that it was now a matter of ending civil war rather than avoiding it, but has come under fire for failing to call for Assad's ouster.

Syria -- which insists it is fighting an insurgency by "armed terrorist groups" backed by the West, Gulf states and Turkey -- said that to speak of civil war "contradicts reality".

However, the escalating violence prompted the UN to end its observer mission in Syria on Sunday.

The conflict has descended into a bloody stalemate, with scores of people reportedly being killed every day as the regime battles rebels in their main strongholds and other pockets of resistance across the country.

A top Free Syrian Army commander, Colonel Abdel Jabbar al-Okaidi, said the rebels held sway in more than 30 districts of Aleppo, the country's now battered commercial capital that had largely avoided the conflict until a month ago.

"We now control more than 60 percent of the city of Aleppo, and each day we take control of new districts," Okaidi said. "The people are with us... How else do you think we could have lasted a month?"

But a security source in Damascus dismissed the claims.

"This is completely false," the source told AFP. "The terrorists are not advancing, it is the army that is making slow progress.

The regime has warned of a "mother of all battles" to recapture Aleppo, where the Britain-based Observatory reported shelling on Tuesday that killed nine civilians, among them two women and two children.

War planes also pounded the towns of Marea and Tall Rifaat to the north, the Britain-based Observatory said.

"The army bombarded rebel weapons stocks in the Aleppo region to prevent the arms from reaching them (in the city)," the Syrian security official told AFP. "Reinforcements from both sides are heading to Aleppo. It is a war that will last a long time."

Tuesday's violence followed a bloody day in which 167 people were killed nationwide, the Observatory said.

The Syrian conflict echoed in neighbouring Lebanon overnight, with running clashes between pro- and anti-Damascus regime supporters leaving 33 people wounded in the northern port city of Tripoli, security officials said.

Court strikes down EPA rule on coal pollution

WASHINGTON (Reuters) - A U.S. appeals court on Tuesday overturned a key Obama administration rule to reduce harmful emissions from coal-burning power plants, sparking a rally in coal company shares and relief among utility firms.

The U.S. Court of Appeals for the D.C. Circuit said in a 2-1 decision that the Environmental Protection Agency had exceeded its mandate with the rule, which was to limit sulfur dioxide and nitrogen oxide emissions from power plants in 28 mostly Eastern states and Texas.

In the latest setback for the EPA, the court sent the Cross-State Air Pollution Rule back for revision, telling the agency to administer its existing Clean Air Interstate Rule - the Bush-era regulation that it was updating - in the interim. The EPA said it was reviewing the ruling.

The decision was cheered by some Republicans, who have made the EPA and President Barack Obama's environmental policies a major campaign theme ahead of November elections.

The agency is endangering a fragile economic recovery by saddling U.S. industries with costly new rules, Republicans say.

"The Obama-EPA continues to demonstrate that it will stop at nothing in its determination to kill coal," said Republican Senator James Inhofe, one of the Senate's most vocal EPA opponents. "With so much economic pain in store, it is fortunate that EPA was sent back to the drawing board."

Power groups, which had argued that they could not meet the timeframe or bear the financial burden of installing costly new equipment, welcomed the court's decision. The EPA had estimated it would cost $800 million annually from 2014.

"The court was clear in finding that EPA had overstepped its legal authority in developing the rule," said Scott Segal, director of the Electric Reliability Coordinating Council.

Coal company stocks, which have suffered this year as cheap natural gas undercut demand for coal from power companies, soared. Peabody Energy was 3.7 percent higher and Arch Coal rose 1.1 percent.

U.S. natural gas futures briefly fell more than 3 percent after the ruling's announcement as traders bet it would mean less demand for the cleaner fuel over the coming months. By midday, prices had recovered those losses.

But some analysts saw little material impact from the ruling, with dozens of coal-fired plants already slated for closure due to other EPA regulations.

"It gives the EPA a little bit more of a black eye," said Andrew Weissman, senior energy adviser at law firm Haynes and Boone, which advises power and gas sector clients.

"But in the bigger picture, it may not be important in terms of the practical consequences."

POLLUTION CONTROLS

The EPA's rule was designed to reduce sulfur dioxide emissions by 73 percent and nitrogen oxide by 54 percent at coal-fired power plants from 2005 levels, improving health for over 240 million people, according to the agency. The reasoning is that unhealthy emissions from those plants, pollutants that cause acid rain and smog, cross state lines.

Two of the three judges ruling on the case said the EPA had exceeded its "jurisdictional limits" in interpreting the Clean Air Act and imposed "massive emission reduction requirements" on upwind states.

"By doing so, EPA departed from its consistent prior approach to implementing the good neighbor provision and violated the (Clean Air Act)," Judge Brett Kavanaugh said in the court's opinion.

The rule, known as CSAPR, also established a cap-and-trade system that enabled power producers to comply with the emission limits by buying, trading and selling pollution permits.

Environmental market traders said they were "surprised and disappointed" by the ruling.

Power generators, such as Southern Co, had argued that the January 1 implementation date was too soon to design and install the needed pollution control equipment.

Texas, along with the National Mining Association and the International Brotherhood of Electrical Workers, also challenged the EPA, arguing the rule would cause undue financial burden on power producers and force companies to shut some older plants.

"Vindicating the state's objections to EPA's aggressive and lawless approach, today's decision is an important victory for federalism and a rebuke to a federal bureaucracy run amok," said Greg Abbott, attorney general in Texas, where the power industry had warned that the rule could result in peak-season blackouts.

Democratic Senator Tom Carper, who authored bills to curb mercury, SOX and NOx emissions in previous years, said he would try to push for new legislation if an appeal failed.

EPA OVERREACH?

Segal of the Electric Reliability Coordinating Council said the CSAPR, along with other EPA rules, did not show sufficient respect or deference to state programs.

"Today's decision is a stern warning against EPA's recent views," he said.

Luke Popovich, a spokesman for the National Mining Association, hailed the ruling.

"This was not entirely surprising because it's the third or fourth ruling by a federal court that shows the EPA to be overriding the authority that the states have and conducting an unlawful regulatory program against coal," he said.

Environmental groups warned that the decision would put lives at risk and urged the EPA to appeal the decision.

"The court's decision significantly imperils long overdue clean air safeguards for millions of Americans," said Vickie Patton, general counsel of the Environmental Defense Fund.

Patton said the EPA should move in parallel to "swiftly put in place replacement protections" and to ask the three-judge panel and the full court to rehear the case.

John Walke, clean air director at the Natural Resources Defense Council, said the dissenting opinion of Judge Judith Rogers more accurately reflected the opinion of the court.

"The EPA can - and should - immediately appeal this decision. The dissenting judge correctly follows the Clean Air Act and prior rulings by this court. The majority opinion is an outlier at odds with the court's own rulings as well as the Clean Air Act," Walke said.

Judge Rogers said the other two judges were "trampling on this court's precedent on which the Environmental Protection Agency was entitled to rely in developing the Transport Rule rather than be blindsided by arguments raised for the first time in this court".

The appeals court had in June ruled 2-1 in favor of the EPA in a challenge to the agency's greenhouse gas regulations.

Weight-loss surgery results in positive changes in social life, medical conditions

ScienceDaily (Aug. 18, 2012) ? New research shows that people who have bariatric surgery to treat obesity report an overall improvement in quality of life issues after surgery, from their relationships to their medical conditions. Arizona State University researchers presented their findings at the 107th Annual Meeting of the American Sociological Association in Denver, Colorado on August 20.

Obesity is an epidemic in the United States with more than one-third of adults over age 20 classified as obese. Bariatric surgery is an increasingly common procedure that individuals are turning to that typically results in dramatic weight loss -- sometimes of 100 pounds or more. According to the American Society for Metabolic and Bariatric Surgery, about 220,000 people underwent bariatric surgery in 2009 in the United States, up from about 13,300 procedures in 1998.

The paper, "Social and Health Changes Following Bariatric Surgery," examines how patients who had the surgery fared afterward. The researchers collected data from 213 patients ranging in age from 26 to 73 years old, with an average age of 50, through a self-selected sample of participants in an online support group.

"We thought there would be more negative reactions to the surgery, but the response was very positive," said study co-author Jennie Jacobs Kronenfeld, an ASU School of Social and Family Dynamics professor. "Most people had improvements in chronic health problems."

Health issues that respondents reported improvements in included diabetes, heart disease, cholesterol level, and sleep apnea. Study respondents also cited increased mobility as one of the positive aspects of having surgery to lose weight. Weight loss among participants averaged 95 pounds per person while the range of weight experiences was wide -- from a gain of 80 pounds, which is atypical according to the researchers, to a weight loss of 260 pounds.

People who elected to have the surgery to reduce negative reactions to their weight among friends and family reported better relationships after surgery. Respondents also reported a decrease in depression after the surgery.

"This provides evidence that overcoming the stigma of being overweight, as reflected by negative reactions of others, can lead to greater satisfaction among relationships with family and friends, and in social life in general," said Doris A. Palmer, co-author of the paper and a doctoral student in the School of Social and Family Dynamics sociology program at ASU.

Satisfaction with how participants felt about their appearance was lower on average than satisfaction with other aspects after the surgery.

"They were satisfied, but not as pleased about the way they looked as with other aspects of their lives," Kronenfeld said. "They may have hanging skin and those kinds of issues to deal with. It's not clear if most insurance companies will cover treatment of those issues since it may be considered cosmetic."

Researchers asked a variety of questions in the survey that was made available through an online support group for bariatric patients. Study questions examined physical health, self esteem, social life, work life, family life, mobility, and satisfaction with surgery results.

Motivators to have the surgery in order were: to decrease the risk of health problems; to improve overall health; to improve appearance; and to boost self esteem. Respondents also cited the ability to be physically active -- for instance, being able to play on the floor with their children if they hadn't been able to manage that in the past when they were larger. Overcoming society's stigma of being overweight was another benefit respondents noted after losing weight.

You really don?t need much. The skinny for 1 serving is 132 calories, 1.8 grams of fat and 4 Weight Watchers POINTS PLUS. This includes a little light whipped cream and caramel drizzle on top. A Starbucks Caramel Frappuccino Light has 152 calories and 1.3 grams of fat not including whipped cream or caramel drizzle. Sit down, relax and enjoy this rich tasting, chilly treat. Prep Time: 10 minutes

Ingredients for Frappuccino:

? cup double-strength regular or decaf coffee, chilled, see prep tip

? cup (1%) low-fat milk, see substitution tip

2 tablespoons caramel topping

4 packages Splenda, Stevia, Equal or your favorite sugar substitute

2 teaspoons sugar

1? teaspoons vanilla extract

2? cups ice

Ingredients for Topping:
Light whipped cream or light vanilla flavored whipped cream, see shopping tip

1? teaspoons caramel topping

Instructions
1. Combine chilled coffee, milk, 2 tablespoons caramel topping, Splenda, sugar, vanilla and ice in a blender. Blend on high speed until ice is crushed and drink is smooth. Pour into 2 glasses.

2. Top each glass with 2 tablespoons whipped cream and drizzle about ? teaspoon caramel topping over each.

3. Serve at once with a straw, if desired

Make double-strength regular or decaf coffee by brewing with twice the coffee required by your coffee maker. Use 2 tablespoons of ground coffee per each cup of coffee. Chill before using. Make extra, if desired, to keep on hand in the refrigerator.

I like to used fresh brewed hazelnut flavored coffee for this recipe because I love hazelnut coffee but any regular or decaf coffee will work.

Substitution Tip
To cut the calories and fat further, use nonfat milk instead of 1% and all Splenda, no sugar. Tropical storm hits Mexico coast, quickly weakens

(AP) VERACRUZ, Mexico - Tropical Storm Helene quickly weakened into a tropical depression Saturday after moving ashore on Mexico's Gulf Coast, bringing strong rains but few reports of damage.

Forecasters said Helene still posed a threat to areas where thousands of people are recovering from flooding spawned last week by Hurricane Ernesto, although the Veracruz state civil defense office said none of the region's numerous rivers had overflowed. Some streets flooded in low-lying neighborhoods of the port city of Veracruz.

The U.S. National Hurricane Center said the depression had winds of about 30 mph (45 kph) Saturday afternoon. It was 65 miles (105 kilometers) west-northwest of Tampico, an oil-refining center and important port in Tamaulipas state. The city with about 790,000 inhabitants sits just above sea level and is surrounded by lakes and lagoons vulnerable to flooding.

Helene was moving west-northwest at 5 mph (7 kph), and was expected to dissipate Saturday night or early Sunday.

The storm came ashore early Saturday in a lush coastal region of oil centers and tourist resorts with hundreds of towns and villages lying beside streams and rivers that can swell dangerously in heavy rain. Many were evacuated as Ernesto approached last week, and flood damage left some 10,000 people homeless.

The U.S. hurricane center said an additional 2 inches (5 centimeters) to 4 inches (10 centimeters) of rain could fall across northern Veracruz, southern Tamaulipas and eastern San Luis Potosi state.

Veracruz state Civil defense Secretary Noemi Guzman said "moderate to intense" rain had fallen in the northern part of the state, which borders Tamaulipas. Guzman urged residents to stay at home and avoid venturing out in the storm.

In the Atlantic, Tropical Storm Gordon strengthened into a hurricane as it moved toward the east on a track that could take it near the eastern Azores islands Sunday night. The storm had maximum sustained winds of 105 mph (165 kph) and it was 590 miles (950 kilometers) west-southwest of the Azores.
